Peru Mining News Update: Streamlining of Mining Permit Process

In a significant move aimed at bolstering its mining sector, the Peruvian Ministry of Energy and Mining (MINEM) has recently introduced a new Decree that marks a shift in the environmental certification procedures for mining companies. The key focus of this decree is the simplification and integration of processes related to environmental certification and water use permits, both of which are crucial for the seamless operation of mining activities.

Streamlining Processes

The modification to the Environmental Protection in Mining Activities act is a game-changer for companies seeking to explore mining sites. It will consolidate the water use permit application within the environmental certification process. Previously, companies were required to navigate two separate and sequential processes, creating significant bureaucratic hurdles and delays. With the new decree, a company only needs to request environmental certifications, and the approval for the water use permit will be seamlessly integrated into the same process.

Benefits of Simultaneous Processes

The integration of these previously distinct procedures translates to a substantial reduction in time and resources for mining companies. By synchronising the approval of water use permits with environmental certifications, MINEM aims to expedite the entire permitting process. This not only simplifies the administrative burden on companies but also accelerates the commencement of mining activities. Previously, companies were compelled to wait until environmental certifications were issued before initiating the separate process for water use permits. Those who opt not to pursue simultaneous processing can now apply for the water usage authorisation immediately after obtaining approval for the environmental study.
